Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of and incorporated by reference into the Sugra Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service. This AUP supplements, and does not limit, the prohibitions set forth in the Terms of Service and the Data Use Policy.
1. Purpose
This AUP defines conduct that is prohibited when accessing or using the Service. Compliance with this AUP is a condition of your right to use the Service. Sugra may update this AUP from time to time as described in Section 4 below.
2. Prohibited Activities
You shall not, and shall not permit any User or third party acting on your behalf to, engage in any of the following activities:
2.1 Commercial and redistribution abuse
- Reselling, sublicensing, or providing access to the Service or your API keys to any third party not covered by your subscription.
- Redistributing, re-publishing, or licensing the Data as a standalone data product, feed, or dataset.
- Building, operating, or contributing to a service whose primary function is the aggregation, mirroring, or re-publication of data obtained through the Service.
- Using the Service to develop or improve a product that competes with the Service as a data aggregation layer.
2.2 Technical abuse
- Extracting, harvesting, or downloading Data in bulk, or at volumes or cadences that exceed the rate limits applicable to your subscription tier.
- Using headless browsers, rotating proxies, multiple or synthetic accounts, credential sharing, or other techniques to circumvent rate limits, quotas, authentication, or billing controls.
- Reverse engineering, decompiling, or attempting to derive the source code, internal algorithms, or the identity of specific Upstream Sources underlying any response.
- Probing, scanning, or testing the vulnerability of the Service, bypassing any security or access control mechanism, or accessing any account, system, or network that you are not authorized to access.
- Uploading, transmitting, or introducing any virus, worm, malware, ransomware, logic bomb, or other harmful code into the Service.
- Interfering with or disrupting the Service, its infrastructure, or any other user's access to the Service, including denial-of-service or distributed denial-of-service activity.
2.3 Regulatory and ethical abuse
- Using the Service or the Data to engage in market manipulation, insider trading, benchmark manipulation, or any activity that violates applicable securities, commodities, or derivatives regulation.
- Using the Service to facilitate money laundering, terrorist financing, sanctions evasion, fraud, tax evasion, or any other unlawful activity.
- Using the Service in violation of any applicable export control law, sanctions program administered by OFAC, or similar U.S. or international regulation.
- Using the Service on behalf of, or for the benefit of, any person or entity identified on the U.S. Specially Designated Nationals and Blocked Persons List, or any analogous list maintained by the United Nations, the European Union, or the United Kingdom.
2.4 Access by minors
- Providing access to the Service to any individual under eighteen (18) years of age.
2.5 Reputational and legal abuse
- Using the Service to harass, threaten, defame, or violate the legal rights of others.
- Misrepresenting the source of the Data, falsely attributing the Data to a party other than Sugra or the applicable Upstream Source, or using the Data to create misleading or deceptive outputs.
3. Enforcement
Sugra takes violations of this AUP seriously. The following enforcement framework applies:
3.1 Ordinary violations
For violations of moderate severity, Sugra's standard practice is graduated enforcement:
- Warning. Sugra will notify the Subscriber of the violation and request remediation within a reasonable period.
- Suspension. If the violation is not remedied, or if further violations occur, Sugra may suspend access to the Service in whole or in part.
- Termination. Sugra may terminate the Subscriber's account if suspension does not result in remediation, or for repeated or continuing violations.
3.2 Severe violations
For severe violations, Sugra may suspend or terminate access immediately, without prior notice. Severe violations include, without limitation:
- Sanctions violations or service to sanctioned persons (Sections 2.3(13) and 2.3(14)).
- Use of the Service for fraud, money laundering, terrorist financing, or other unlawful financial activity (Section 2.3(12)).
- Market manipulation or insider trading (Section 2.3(11)).
- Introduction of malicious code or active attacks on the Service (Sections 2.2(9) and 2.2(10)).
- Any conduct that, in Sugra's reasonable judgment, poses an imminent threat to the Service, other users, or Sugra's lawful business operations.
3.3 No refund on termination
If Sugra suspends or terminates a Subscriber's account for violation of this AUP, the Subscriber is not entitled to any refund of Fees paid. This applies to ordinary and severe violations alike.
3.4 Cooperation with authorities
Sugra may cooperate with law enforcement, regulatory authorities, and other lawful requests, including by preserving and disclosing account information and content where required by law or where Sugra in good faith considers such disclosure necessary to prevent imminent harm.
4. Reporting and Changes
Suspected violations of this AUP or other abuse of the Service should be reported to abuse@sugra.systems. Reports should include sufficient detail to allow Sugra to investigate, including any relevant account identifiers, timestamps, and URLs.
Sugra may modify this AUP from time to time. For material changes, Sugra will provide at least thirty (30) days' advance notice by email to the address on file and a prominent notice at sugra.systems, and will update the "Last updated" date above. Continued use of the Service after the effective date of a change constitutes acceptance.
